END-USER LICENSE AGREEMENT (EULA)
FOR SPELLING BORG: STANDARD LICENSE

This license applies to the standard-licensed version of Spelling Borg. If you have an evaluation version of Spelling Borg, see End-User License Agreement For Spelling Borg: Evaluation License.

TERMS USED IN THIS AGREEMENT

As used herein, the term “Licensor” shall refer to STRING CODES DESIGN (registered in British Columbia, Canada); the term “Licensee” shall refer to either an individual or a single entity, which has purchased this License from the Licensor; the term “Software” shall refer to the software SPELLING BORG, which includes computer software and spelling media titles, and may include associated media, electronic documentation, and any other materials associated with it. The “Software” also includes any updates and supplements to the original Software provided to you by the Licensor.

This End-User License Agreement ("EULA") is a legal agreement between the Licensee and the Licensor for the Software. By installing, copying, downloading, accessing, or otherwise using the Software, the Licensee agrees to be bound by the terms of this EULA.

SOFTWARE PRODUCT LICENSE

The Software is protected by copyright laws and international copyright treaties, as well as other intellectual property laws and treaties. The Software is licensed, not sold. This is a license agreement. This is not an agreement for a sale.

LICENSE TO USE THE SOFTWARE

The Licensor grants the Licensee a personal, nonexclusive license to use copy of the Software. One registered copy of this software may be used by a single person who uses the software personally on a single or more computers. Only one copy of the Software is allowed to be run at any time. The Licensee may make one copy of the Software for backup or archival purposes.

LICENSE RESTRICTIONS

You agree not to reverse engineer, decompile, disassemble, modify, adapt, or translate the Software or otherwise attempt to discover the source code of the Software, except and only to the extent that such an activity is expressly permitted by applicable law notwithstanding this restriction. You agree not to transfer and distribute copies of the Software, or make available the Software on a public network. You agree not to share or make available your registered copy registration information (the combination of your User ID and Serial Number) to other parties.

SOFTWARE DISTRIBUTED UNDER THE LICENSE IS DISTRIBUTED ON AN "AS IS" BASIS WITHOUT WARRANTY OF ANY KIND. LICENSOR AND ALL CONTRIBUTORS TO THE SOFTWARE DISCLAIM ALL WARRANTIES AND CONDITIONS, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NONINFRINGEMENT, WITH REGARD TO THE SOFTWARE, AND THE PROVISION OF OR FAILURE TO PROVIDE SUPPORT SERVICES STATED ABOVE. IN NO EVENT SHALL LICENSOR AND ALL CONTRIBUTORS TO THE SOFTWARE BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES (INCLUDING, BUT NOT LIMITED TO, PROCUREMENT OF SUBSTITUTE GOODS OR SERVICES; LOSS OF USE, DATA, OR PROFITS; OR BUSINESS INTERRUPTION) HOWEVER CAUSED AND ON ANY THEORY OF LIABILITY, WHETHER IN CONTRACT, STRICT LIABILITY, OR TORT (INCLUDING NEGLIGENCE OR OTHERWISE) ARISING IN ANY WAY OUT OF THE USE OF THIS SOFTWARE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGE. YOU ACKNOWLEDGE THAT YOU HAVE READ THIS LICENSE, UNDERSTAND IT, AND AGREE TO BE BOUND BY ITS TERMS.

This EULA is governed by the laws of British-Columbia, Canada.
