END-USER LICENSE AGREEMENT (EULA)
FOR SPELLING BORG: EVALUATION LICENSE

This license applies to the evaluation-licensed version of Spelling Borg. If you have a standard version of Spelling Borg, see End-User License Agreement For Spelling Borg: Standard License.

TERMS USED IN THIS AGREEMENT

As used herein, the term “Licensor” shall refer to STRING CODES DESIGN (registered in British Columbia, Canada); the term “Licensee” shall refer to either an individual or a single entity, which has purchased this License from the Licensor; the term “Software” shall refer to the software SPELLING BORG, which includes computer software and spelling media titles, and may include associated media, electronic documentation, and any other materials associated with it. The “Software” also includes any updates and supplements to the original Software provided to you by the Licensor.

This End-User License Agreement ("EULA") is a legal agreement between the Licensee and the Licensor for the Software. By installing, copying, downloading, accessing, or otherwise using the Software, the Licensee agrees to be bound by the terms of this EULA.

SCOPE OF LICENSE

This is not free software. Subject to the terms below, you are hereby licensed by Licensor to use one copy of the Software, on one (1) computer or workstation, for evaluation purposes without charge for a period of 30 days. If you use this software after the 30-day evaluation period, a license fee of $19.75 is required. Payments must be in U.S. dollars drawn on a U.S. or Canadian bank, and should be sent to String Codes Design., PO BOX 44068, Burnaby, BC V5B4Y2, Canada. Use of Spelling Borg after the 30-day evaluation period without payment of the license fee is a breach of this License and a violation of copyright laws.

Subject to all of the terms of this License, you may, without making any payment to Licensor: a) give exact copies of this evaluation version of Spelling Borg personally to anyone; b) distribute exact copies of this evaluation version of Spelling Borg, if done exclusively through electronic channels; and c) make as many exact copies of this evaluation version of Spelling Borg as you wish, for purposes of distribution as described in (a) and (b) above. YOU ARE SPECIFICALLY PROHIBITED FROM CHARGING, OR REQUESTING DONATIONS, FOR ANY COPIES, HOWEVER MADE, AND FROM DISTRIBUTING SUCH COPIES WITH OTHER PRODUCTS OF ANY KIND, COMMERCIAL OR OTHERWISE, WITHOUT PRIOR WRITTEN PERMISSION FROM LICENSOR RESERVES THE RIGHT TO REVOKE THE ABOVE DISTRIBUTION RIGHTS AT ANY TIME, FOR ANY OR NO REASON.

LICENSE RESTRICTIONS

You agree not to reverse engineer, decompile, disassemble, modify, adapt, or translate the Software or otherwise attempt to discover the source code of the Software, except and only to the extent that such an activity is expressly permitted by applicable law notwithstanding this restriction.

SOFTWARE DISTRIBUTED UNDER THE LICENSE IS DISTRIBUTED ON AN "AS IS" BASIS WITHOUT WARRANTY OF ANY KIND. LICENSOR AND ALL CONTRIBUTORS TO THE SOFTWARE DISCLAIM ALL WARRANTIES AND CONDITIONS, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NONINFRINGEMENT, WITH REGARD TO THE SOFTWARE, AND THE PROVISION OF OR FAILURE TO PROVIDE SUPPORT SERVICES STATED ABOVE. IN NO EVENT SHALL LICENSOR AND ALL CONTRIBUTORS TO THE SOFTWARE BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES (INCLUDING, BUT NOT LIMITED TO, PROCUREMENT OF SUBSTITUTE GOODS OR SERVICES; LOSS OF USE, DATA, OR PROFITS; OR BUSINESS INTERRUPTION) HOWEVER CAUSED AND ON ANY THEORY OF LIABILITY, WHETHER IN CONTRACT, STRICT LIABILITY, OR TORT (INCLUDING NEGLIGENCE OR OTHERWISE) ARISING IN ANY WAY OUT OF THE USE OF THIS SOFTWARE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGE. YOU ACKNOWLEDGE THAT YOU HAVE READ THIS LICENSE, UNDERSTAND IT, AND AGREE TO BE BOUND BY ITS TERMS.
